These Terms & Conditions ("Agreement") form an agreement between you ("User", “You”) and DOT DRIVER CERTIFICATION LLC ("DOT DRIVER CERTIFICATION", “We”, “Us”, “Our”). By accessing or using DOT DRIVER CERTIFICATION’s platform, services, online learning system, certification exams, or any related courses and materials (collectively, the “Services”), you accept and agree to be bound by all the terms outlined below. If you do not agree, you may not use the Services. This Agreement includes limitations of liability, mandatory arbitration, and other critical terms that affect your legal rights. Please read carefully.

1. License Grant

Subject to your payment of all applicable fees, DOT DRIVER CERTIFICATION grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Services purchased by you through DOT DRIVER CERTIFICATION. This license is for your personal professional education and certification only. The license applies only to the specific courses, exams, or materials you purchase and does not include any rights to reproduce, distribute, modify, or make derivative works from any content unless explicitly permitted in writing. Any unauthorized use of the platform or materials will constitute a breach of this Agreement and may result in license termination and legal action.

2. Usage Restrictions

Under this Agreement, you agree not to:

  • Share, rent, lease, resell, sublicense, or transfer your access rights to any other person or entity.
  • Provide access credentials to another user, including your login ID and password.
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the platform or any associated software.
  • Copy, modify, or create derivative works based on the course content, exams, platform, media, or any supporting materials.
  • Use the Services for commercial purposes, including selling content, offering training to others, or integrating our content into your offerings.
  • Download, record, or reproduce course content, including text, videos, or digital materials, for offline use unless explicitly permitted.
  • Conduct load testing, security scanning, penetration testing, or similar activities without prior written approval from DOT DRIVER CERTIFICATION.
  • Remove or obscure copyright, trademark, or proprietary notices.

Violating these restrictions will result in immediate termination of your license and may lead to further legal action.

3. Ownership and Intellectual Property

All materials accessed through DOT DRIVER CERTIFICATION’s platform—including but not limited to course content, exam questions and answers, system interface, software, graphics, videos, animations, documentation, branding, and assessments—are the intellectual property of DOT DRIVER CERTIFICATION or its licensors. These are protected by U.S. and international copyright, trademark, and other intellectual property laws. No ownership rights are transferred to you under this Agreement. You may not use DOT DRIVER CERTIFICATION’s name, logo, or content for any purpose outside the scope of this Agreement without written permission.

4. Term and Access

Each course or certification program you purchase will be available to you for a fixed duration of one (1) year from the purchase date unless otherwise stated. Access to the service automatically terminates upon expiration or upon issuance of a certification, where applicable. Course and exam licenses are tied to your individual account and cannot be transferred, extended, or reassigned. DOT DRIVER CERTIFICATION reserves the right to modify, replace, or retire course content, exam formats, or certification requirements at any time without notice.

5. Termination and Suspension

DOT DRIVER CERTIFICATION may terminate or suspend your access to Services at its sole discretion if you breach this Agreement, misuse the platform, or engage in any activity that compromises the integrity of our certification programs (including exam cheating). In such cases, no refund will be provided. You may also voluntarily terminate your access by notifying us in writing. Upon termination, any rights granted to you under this Agreement will cease. Sections related to Ownership, Usage Restrictions, Limitations of Liability, and Arbitration will survive termination.

6. Third-Party Content and Providers

Some Services may incorporate or link to third-party materials, tools, or providers. These third parties may impose their own terms and conditions. You agree to comply with all applicable third-party terms. DOT DRIVER CERTIFICATION is not responsible for the accuracy, availability, or functionality of third-party content and disclaims all liability arising from your interaction with them.

7. Content Updates and Accuracy

DOT DRIVER CERTIFICATION aims to provide up-to-date and accurate training content aligned with industry standards and regulations. However, information, including Department of Transportation (DOT) rules and regulations, may change. DOT DRIVER CERTIFICATION makes no guarantee of the completeness, accuracy, or relevance of content at any given moment. You are responsible for verifying current information with official sources. Course materials are intended as educational aids and should not substitute for legal, regulatory, or professional advice.

8. Warranty Disclaimer

ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” DOT DRIVER CERTIFICATION MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. DOT DRIVER CERTIFICATION does not guarantee uninterrupted access or the absence of errors. You assume full responsibility for using the Services. Successful completion of a course or exam does not guarantee employment, regulatory approval, or certification by any governmental body unless explicitly stated.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DOT DRIVER CERTIFICATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. DOT DRIVER CERTIFICATION’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC COURSE OR SERVICES THAT GAVE RISE TO THE CLAIM. This limitation forms an essential part of the Agreement and survives its termination.

10. Governing Law

This Agreement and all related documents, and all matters arising out of or relating to this Agreement, whether sounding in contract, tort, or statute, are governed by, and construed in accordance with, the laws of the State of Wyoming, and the federal laws of the United States applicable therein, without giving effect to any choice or conflict of law provision or rule that would cause the application of the laws of any jurisdiction other than those of the State of Wyoming.

11. Arbitration Agreement and Class Action Waiver

All disputes arising from or related to this Agreement or your use of our Services shall be resolved through binding arbitration rather than in court, except for individual claims in small claims court. You waive the right to participate in class actions or other representative proceedings. The arbitration will be administered under the Federal Arbitration Act and conducted by a neutral arbitrator. Before starting arbitration, both parties agree to first attempt informal resolution. You may opt out of arbitration within 30 days of first agreeing to these terms by emailing contact@dotdrivercertification.com. Opting out does not affect the rest of this Agreement. If 30 or more similar claims are filed in close proximity (a “Mass Filing”), the parties agree to follow a bellwether process before proceeding with full arbitration for all claims.

12. Automatic Renewals

If you choose to enroll in auto-renewal for any subscription or service, your payment method will be charged automatically at the renewal date. You can cancel auto-renewal at any time prior to the next billing date by logging into your DOT DRIVER CERTIFICATION account and adjusting your subscription settings.

13. Modifications to the Agreement

DOT DRIVER CERTIFICATION may update or modify this Agreement at any time. We will notify users through our website or via email of any material changes. Continued use of Services after changes take effect constitutes acceptance of the updated terms. Changes are effective only going forward and do not apply retroactively.

14. Messaging Terms

By providing your phone number and/or email address, you consent to receive transactional and informational SMS, WhatsApp messages, Emails, and Calls from DOT DRIVER CERTIFICATION LLC. Consent is not a condition of purchase. Messages may include course reminders, exam schedules, account notifications, compliance updates, and occasional promotional messages if you have consented. You may unsubscribe at any time by replying STOP (for SMS/WhatsApp) or contacting us at contact@dotdrivercertification.com (for Emails/Calls). We will not share your contact information with unauthorized third parties.

15. Privacy Policy

Your use of the Services is subject to DOT DRIVER CERTIFICATION’s Privacy Policy, which is hereby incorporated by reference into this Agreement. By accepting this Agreement, you consent to our use of your information in accordance with our Privacy Policy.

16. Grievance Resolution

If you have a concern with any part of your experience or the services provided, please contact our Customer Support Team at contact@dotdrivercertification.com. Include a clear and detailed explanation of your concern so we can review the matter and work toward a prompt resolution.

17. Refund or Cancellation

Your use of the Services is subject to DOT DRIVER CERTIFICATION’s Refund Policy, which is hereby incorporated by reference.

  • Refund requests must be made within 72 hours of your purchase.
  • You are NOT eligible for a refund if you have:
    • Attempted any part of a test or exam.
    • Requested or received a certificate of completion.
    • Completed 50% or more of the purchased course content.
    • Accessed or downloaded significant downloadable materials.
  • For Refund or Cancellation requests, please email us at contact@dotdrivercertification.com.
  • Approved refunds may take up to 10 business days to process and will be issued to the original payment method.
